Surrogacy Arrangements

Surrogacy is a form of assisted reproduction where a woman carries a pregnancy on behalf of another person or couple. For some intended parents it is the only realistic path to having a child. Surrogacy in Western Australia is governed by the Surrogacy Act 2008 and the Human Reproductive Technology Act 1991.

What's involved

Surrogacy has clinical, emotional and legal requirements for everyone involved. In broad terms:

  1. Counselling and medical and psychological assessment for all participants

  2. Independent legal advice for each party before an arrangement is signed

  3. An application to the Reproductive Technology Council of Western Australia for approval

  4. An IVF cycle to create embryos, followed by transfer to the surrogate

​

The timeline is set by the counselling, legal and approval requirements rather than the medical treatment.
